Sale prices will be posted once the closings have taken place.


Sale Method:  The real estate will be offered in 6 tracts and combinations of tracts 1 and 2, and tracts 3, 4 and 5.  Combination bids will be accepted after each tract has been offered individually and only with a minimum initial increase of $10,000.  Bidding increments and any tie bids are at the discretion of the Auctioneer.  All decisions of the Auctioneer are final.  

Terms:  20% earnest deposit is required at the signing of the Purchase Agreement immediately following the auction.  Balance of purchase price is payable in certified funds at closing, on or before April 30, 2008.  The Purchase Agreement will not be contingent on financing.  In the event the Buyer fails to close on or before the closing date for any reason, Seller may declare the Purchase Agreement null and void, with the Buyer’s earnest money deposit forfeited to the Seller.  At Seller’s option, Buyer shall pay interest at the annual rate of 12% from the date of scheduled closing until the actual closing.  Seller will provide marketable title to the Buyer, evidenced by a policy of title insurance.  Cost of title insurance and an insured closing by Phelps County Abstract and Title to be shared 50/50 by Seller/Buyer.  Property sells subject to easements, rights-of-way, zoning and restrictions of record, free and clear of all liens.  Property sells in “as is” condition; no warranty is expressed or implied.

Possession:  At closing, full possession for the 2008 crop year.  

Taxes:  All 2007 taxes paid by Seller, all 2008 taxes paid by Buyer.

Mineral Rights:  Seller reserves a right to one-half any oil and mineral rights for a 10-year period.

Acreages:  Reported acreages obtained from the Harlan County USDA-FSA Office and Harlan County Assessor.  Tracts sell without regard to exact acres.  No warranty is expressed or implied as to exact acres.  Legal descriptions are subject to existing fence/field boundaries.  All potential bidders are encouraged to personally inspect the property, its condition, and to rely on their own conclusions. 

Approval of Bid:  Final sale is subject to the Seller’s approval or rejection of any or all bids.

Tract 5:  Southeast ¼, the East ½ of the Northwest ¼, West ½ of the Northeast ¼, and the Southeast ¼ of the Northeast ¼ of Section 26, Township 1 North, Range 19 West (SE4, E2 NW4, W2 NE4, SE4 NE4 26-1-19) all in Harlan County, NE.  321.7 est. taxed acres.  2007 est. taxes-$1,833.48, (this tract is assessed with Tract 4).  2007 Occupation tax-$702.00.  Irrigation well #G-094421 drilled 4/97 at 150 gpm, #G-094422 drilled 5/95 at 150 gpm, #G-094423 drilled 6/97 at 150 gpm, #G-094424 drilled 5/97 at 50 gpm, #G-094425 drilled 4/97 at 100 gpm, #G-092935 drilled 7/97 at 320 gpm, #G-094426 drilled 4/97 at 150 gpm. NE4 8-2-19), all in Township 2 North, Range 19 West all in Harlan County, NE.  261 taxed acres.  2007 taxes-$3,787.45.  2007 Occupation tax-$1,288.04.  Irrigation well #G-092339 drilled in 5/97 at 125 gpm, #G-092242 drilled 3/97 at 250 gpm, #G-092243 drilled 6/97 at 275 gpm.  Three submersible wells are tied together.  Reinke 6-tower center pivot #0397-14802 with 17,241 hrs, set-up at 500 gallons and RAMS panel on Section 5.  Manure was applied to this farm in 2006.  Section 8 also had manure applied approximately 5 years ago.  This farm and a portion of Section 5 are irrigated out of the Frenchman-Cambridge canal.  The Seller has been notified by mail that irrigation water is available for 2008.  NRD certified irrigated acres–247.7.  FSA bases – Corn-205.8 acres, 119 bu. yield, Soybeans-58.4 acres, 34 bu. yield.
